1. Acceptance of These Terms

By visiting or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

You must be at least 16 years old to use the Site. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian who agrees to these Terms.

2. Educational Disclaimer (No Guaranteed Outcomes)

The Site provides educational content related to selling outdoor and tourism clothing, including product knowledge, customer consultation, seasonal collections, e-commerce practices, and inventory fundamentals. Educational materials only. No guarantee of income, business growth, or sales performance.

Any examples, checklists, scenarios, or templates are provided for learning and operational consistency. Results vary by market, product assortment, pricing, staffing, and execution. You are responsible for how you apply the information in your own environment.

3. Description of the Site and Changes

The Site includes course descriptions, curriculum information, FAQ content, and forms for registration interest and contact. We may update, improve, remove, or discontinue any part of the Site at any time, including the availability of pages, modules, and downloadable or viewable materials.

We may suspend or block access if we reasonably believe a user is violating these Terms or creating risk for the Site, our users, or our service partners.

5. Intellectual Property

The Site, including its text, structure, design, and educational materials, is owned by Tudelniko Education LLC or licensed to us. All rights are reserved.

We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site for your personal or internal business training purposes. You may not reproduce, distribute, publish, publicly display, or create derivative works from the Site content without our prior written permission, except where such use is permitted by mandatory law.

“tudelniko” and associated names are our identifiers. You may not use them in a way that implies endorsement, affiliation, or sponsorship without permission.

6. Third-Party Services and Links

The Site may reference or link to third-party services (for example, map providers) for convenience. Third-party services are not controlled by us, and we are not responsible for their content, policies, or availability.

Your use of third-party services is subject to the third party’s terms and privacy policies. If you choose to use those services, you do so at your own discretion.

7. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

We do not warrant that the Site will be error-free, secure, or uninterrupted, or that any defects will be corrected. We do not warrant that content will be complete or appropriate for your specific situation.

8. Limitation of Liability

To the maximum extent permitted by law, Tudelniko Education LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of (or inability to use) the Site, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim arising out of or related to the Site will not exceed the greater of (a) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) €100.

Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for intentional misconduct or fraud, or certain statutory consumer rights where applicable.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tudelniko Education LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Site, (b) information you submit through the Site, or (c) your violation of these Terms or applicable law.

10. Force Majeure

We are not responsible for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, governmental actions, internet outages, cyberattacks, or failures of hosting, cloud, or telecommunications providers.

11. International Use

The Site is operated from the European Union. We make no representation that the Site is appropriate or legally available for use in every jurisdiction. If you access the Site from outside the EU, you do so on your own initiative and are responsible for compliance with local laws.

12. Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of laws principles. Where you are a consumer in the European Union, you may also benefit from mandatory consumer protections in your country of residence, and nothing in these Terms limits those rights.

13. Dispute Resolution

Before starting formal proceedings, you agree to contact us and allow thirty (30) days for an informal resolution. If we cannot resolve the issue, either party may pursue claims in the competent courts, subject to mandatory consumer rights that may provide for different venues.

14. Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms, created security risk, or interfered with the operation of the Site. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

16. Entire Agreement

These Terms, together with the Privacy Policy and the Cookie Policy, constitute the entire agreement between you and Tudelniko Education LLC regarding the Site and supersede any prior or contemporaneous understandings on the subject.

17. Assignment

We may assign these Terms (in whole or in part) to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

18. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later. Any waiver must be in writing and signed by an authorized representative of Tudelniko Education LLC.

19. Modifications to These Terms

We may update these Terms from time to time. Changes become effective fourteen (14) days after they are posted on this page, unless a shorter period is required for security or legal reasons. The “Last Updated” date at the top reflects the most recent revision.

20. Electronic Communications

By using the Site and contacting us electronically, you consent to receive communications from us electronically (such as email responses to your inquiries). You agree that electronic communications and notices satisfy any legal requirement that such communications be in writing, where permitted by applicable law.
